Introduction

Welcome to IG Hero! These Terms of Service ("Terms") govern your access to and use of the IG Hero applications, websites, and services (collectively, the "Services"), including but not limited to our Engagement Calculator, social media management tools, and any other features we may offer. By accessing or using our Services, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our Services.

IG Hero ("we," "us," or "our") reserves the right to modify these Terms at any time. We will notify you of any material changes by updating the "Effective Date" above and, where appropriate, providing additional notice. Your continued use of the Services after such modifications constitutes your acceptance of the updated Terms.

Eligibility

You must be at least 13 years of age to use our Services. If you are under 18, you represent that you have your parent's or guardian's permission to use the Services. By using our Services, you represent and warrant that you meet these eligibility requirements and have the legal capacity to enter into these Terms.

If you are using the Services on behalf of an organization or entity, you represent and warrant that you are authorized to agree to these Terms on behalf of that organization, and that the organization agrees to be bound by these Terms.

IG Hero provides a suite of tools designed to help users manage and analyze their social media presence, particularly on platforms like Instagram and Threads. Our Services may include:

• Engagement Calculator: A tool for analyzing engagement metrics and generating insights about social media performance.
• Content Publishing Tools: Features that allow authorized users to publish content to connected social media accounts.
• Analytics and Insights: Reports and data about your social media performance.
• Ad Library Analysis: Tools to browse and analyze publicly available advertising data.

We reserve the right to modify, suspend, or discontinue any part of the Services at any time, with or without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuation of the Services.

User Accounts and Authentication

Some features of our Services may require you to connect your social media accounts (such as Instagram, Facebook, or Threads) through OAuth authentication. When you connect your accounts:

• You authorize us to access certain information from those accounts as permitted by the platform's API and your privacy settings.
• You are responsible for maintaining the security of your account credentials and for all activities that occur under your account.
• You must comply with the terms of service of the platforms you connect (e.g., Instagram, Facebook, Meta, Threads).
• You may disconnect your accounts at any time through our Services or through the connected platform's settings.

You agree to provide accurate, current, and complete information during the registration or connection process and to update such information to keep it accurate, current, and complete.

Acceptable Use

You agree to use our Services only for lawful purposes and in accordance with these Terms. You agree not to:

• Use the Services in any way that violates any applicable law or regulation.
• Use the Services to send, upload, or distribute any content that is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable.
• Attempt to gain unauthorized access to any part of the Services, other accounts, computer systems, or networks connected to the Services.
• Use any robot, spider, scraper, or other automated means to access the Services without our express written permission.
• Interfere with or disrupt the Services or servers or networks connected to the Services.
• Reverse engineer, decompile, or disassemble any portion of the Services.
• Use the Services to spam, phish, or engage in any fraudulent activities.
• Violate the terms of service of any third-party platforms connected through our Services.
• Use the Services to infringe upon the intellectual property rights of others.

We reserve the right to terminate or suspend your access to the Services immediately, without prior notice, for any conduct that we believe violates these Terms or is harmful to other users of the Services, us, or third parties.

Intellectual Property

Our Content

The Services and their original content (excluding content provided by users), features, and functionality are and will remain the exclusive property of IG Hero and its licensors. The Services are protected by copyright, trademark, and other laws. Our trademarks and trade dress may not be used in connection with any product or service without our prior written consent.

Your Content

You retain ownership of any content you submit, post, or display through the Services ("Your Content"). By submitting Your Content to the Services, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and distribute Your Content solely for the purpose of operating and providing the Services to you.

You represent and warrant that: (i) you own Your Content or have the right to grant the license above, and (ii) Your Content does not violate the privacy rights, publicity rights, copyright, contract rights, or any other rights of any person or entity.

Third-Party Services and Platforms

Our Services integrate with third-party platforms and services, including but not limited to Meta (Facebook, Instagram, Threads), and others. Your use of these third-party services is subject to their respective terms of service and privacy policies. We are not responsible for the content, privacy practices, or policies of any third-party services.

We do not control and are not responsible for the actions or omissions of these third parties. If any third-party platform changes its policies, discontinues its services, or revokes our access, we may be unable to provide certain features of our Services, and we shall not be liable to you for any such changes.

API Usage and Rate Limits

Our Services utilize various APIs (Application Programming Interfaces) provided by third-party platforms. These APIs are subject to rate limits and usage restrictions imposed by the platform providers. You acknowledge that:

• The availability and functionality of our Services depend on these third-party APIs.
• We may need to limit your usage of certain features to comply with API rate limits.
• Changes to third-party APIs may affect the functionality of our Services.

We will make reasonable efforts to maintain compatibility with third-party APIs, but we cannot guarantee uninterrupted access to all features at all times.

THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that: (i) the Services will be uninterrupted, timely, secure, or error-free; (ii) the results obtained from the use of the Services will be accurate or reliable; (iii) the quality of any information or content obtained through the Services will meet your expectations; or (iv) any errors in the Services will be corrected.

Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT SHALL IG HERO, ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

• Your access to or use of (or inability to access or use) the Services;
• Any conduct or content of any third party on the Services;
• Any content obtained from the Services;
• Unauthorized access, use, or alteration of your transmissions or content;
• Any actions taken by third-party platforms that affect our Services.

In no event shall our total liability to you for all claims arising out of or relating to these Terms or the Services exceed the amount you paid us, if any, in the twelve (12) months preceding the claim.

Indemnification

You agree to defend, indemnify, and hold harmless IG Hero and its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, and expenses, including without limitation reasonable legal and accounting fees, arising out of or in any way connected with: (i) your access to or use of the Services; (ii) Your Content; (iii) your violation of these Terms; or (iv) your violation of any third-party rights, including intellectual property rights or privacy rights.

Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of Taiwan, without regard to its conflict of law provisions. Any dispute arising from or relating to these Terms or the Services shall be subject to the exclusive jurisdiction of the courts located in Taipei, Taiwan.

Before filing any legal claim, you agree to first contact us and attempt to resolve the dispute informally by sending a written notice of your claim to support@ig-hero.com. We will attempt to resolve any dispute within 30 days of receiving your notice.

Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid, illegal, or unenforceable provision shall be modified to the minimum extent necessary to make it valid, legal, and enforceable while preserving its intent.

Entire Agreement

These Terms, together with our Privacy Policy and any other legal notices or agreements published by us on the Services, constitute the entire agreement between you and IG Hero regarding the Services and supersede all prior agreements and understandings.
